“The British Horseracing Boar?_x0019_s application to strike out that part of the William Hill Defence and Counterclaim relating to Article 82 of the Treaty of Rome (abuse of a dominant position) was successful in the High Court on Wednesday 19th July 2000. Mr. Justice Laddie refused William Hill leave to appeal and also ordered William Hill to pay BH?_x0019_s costs of the application.
The Judge further ordered the trial of the substantive issue of William Hill’s infringement of BHB’s database rights to come on as an expedited trial not before 30 October.

1. In March 2000 the BHB issued proceedings against William Hill, seeking a Declaration from the Courts that it has database rights in its pre-race information and that any betting operator who displays the information on an internet site without a BHB licence is in breach of BHB’s rights.
2. November 2000 is the earliest date for an expedited trial.
